Abstract
De (toenmalige) windturbinenormen in het Activiteitenbesluit milieubeheer zijn in strijd met de SMB-richtlijn, maar de omgevingsvergunning niet. Er is geen (Unierechtelijke) plicht om die vergunning in te trekken.
