Het Benelux merkenrecht in Europees perspectief

Abstract

The thesis gives a broad overview of the current status of the trademark law both on a Benelux and on a Community level. It deals with the changes Benelux Trademark Law has undergone since the European harmonisation, the institution of a Community Trademark and 12 years of case law of the European Court of Justice. The thesis aims at finding tendencies in developments and provides suggestions for amendments and additions. Also, the Benelux and national laws are discussed, as well as the overlap between trademark law and copyright, protection of geographical indications and product liability.
