Abstract

Dutch labour law includes a remarkable legal provision: it should not be affected by the legislation of the standardised contracts. Even if there are clear interfaces, the exclusion is strictly applied by judges. Many of the arguments used by the governnent 30 years ago for the exclusion of the individual and collective labor legislation of the General Conditions, have lost their validity and need adjustment. An opening of the legal provisions of the adhesionary contracts to the individual and, to an much esser extent, collective labor agreement, aimed at a development of the latter to be refully affected, is required.
