Verkrachting: what's in a name?: De voorgenomen strafbaarstellingen van verkrachting en seks tegen de wil in het licht van artikel 36 Istanbul

Abstract

According to Article 36 Istanbul Convention Member States are obliged to criminalize all types of non-consensual sex, including rape. The recent proposal submitted by the Dutch legislator for internet-consultation is not in conformity with the Istanbul Convention, however. Bearing in mind the legality principle, the overinclusive nature of Article 36 Istanbul raises objections.
